Terms of Use
These Terms of Use ("Terms") govern your use of highscale.ai and any related pages (the "Site") operated by High Scale Inc. ("HighScale," "we," "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Who may use the Site
The Site is intended for business use by people who are at least 18 years old. If you use the Site on behalf of a company, you confirm that you have authority to do so.
2. Applying for access
Submitting an application through the Site does not create any agreement or obligation for either party. HighScale onboards a limited number of brands and may accept or decline any application at its sole discretion. Any services we provide will be governed by a separate written agreement, which controls over these Terms.
3. Our content and intellectual property
The Site and everything on it, including text, graphics, videos, images, logos, the HighScale name and the design of the Site, are owned by HighScale or its licensors and are protected by copyright, trademark and other laws. Video and creative work shown on the Site is copyrighted and may not be copied, downloaded, reproduced or used to train any machine learning model without our written permission. We grant you a limited, revocable, non exclusive license to view the Site for your own business evaluation.
4. Acceptable use
You agree not to:
- copy, scrape, crawl or harvest content or data from the Site by automated means, except as allowed in section 5;
- submit false, misleading or someone else's information in our forms;
- interfere with the security or operation of the Site, or attempt to gain unauthorized access;
- use the Site to send spam or to violate any law or the rights of others.
5. Search engines and AI assistants
Search engines and AI assistants are welcome to crawl, index, summarize and cite the public pages of the Site and link to them. Please follow our robots.txt. Plain text summaries for AI assistants are available at /llms.txt and /llms-full.txt. This permission does not cover copying our videos or creative work, or using them to train machine learning models, which section 3 still restricts.
6. Information on the Site
Figures, results and descriptions on the Site are provided for general information. They describe past performance or our current operations and are not a promise of any particular outcome for your business. We may change or remove content at any time.
7. Third party links and services
The Site may link to or rely on third party websites and services, such as our careers page provider. We are not responsible for their content or practices, and your use of them is governed by their own terms.
8. Privacy
Our Privacy Policy explains how we collect and use personal information through the Site.
9. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, HIGHSCALE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR FREE OR FREE OF HARMFUL COMPONENTS.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HIGHSCALE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100).
11. Indemnity
You agree to indemnify and hold harmless HighScale and its officers, employees and agents from any claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute relating to the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
13. Changes
We may update these Terms from time to time by posting a new version on this page. Your continued use of the Site after changes take effect means you accept the updated Terms.
